Pakatan criticises PMO’s statement defending revocation of Emergency Ordinances, says Federal Constitution, parliamentary democracy betrayed

KUALA LUMPUR, July 30 — The Pakatan Harapan (PH) presidential council today chastised the Prime Minister’s Office (PMO) for defending its move to announce the revocation of the Emergency Ordinances (EOs) in Parliament, accusing the government of betraying the Federal Constitution and the parliamentary democracy.
In a statement today, PKR president Datuk Seri Anwar Ibrahim, DAP secretary-general Lim Guan Eng and Parti Amanah Negara (Amanah) president Mohamad Sabu criticised the PMO, saying the root problem lies in the statement made by the de facto law minister, Datuk Seri Takiyuddin Hassan, who had on July 26, announced that the government has revoked the EOs effective July 21.
“However, Istana Negara’s statement yesterday clearly stated that His Majesty the Yang di-Pertuan Agong had not consented to the cancellation, and Takiyuddin had misled the members of the House of Representatives. Therefore, the counter statement of the Prime Minister’s Office yesterday was arrogant and rude towards the Head of State, in violation of the Federal Constitution and the system of parliamentary democracy.
“It is important to note that a government that has lost good relations and is no longer loyal to His Majesty is unlikely to survive,” the trio said.

Malaysia’s daily new Covid cases per million people is now one of the highest globally
- On a seven-day moving average basis, Malaysia recorded 483.72 new confirmed Covid infections per million people on Wednesday, according to the latest data compiled by Our World in Data.
- That number is the eighth highest globally and top in Asia.
- Malaysia has struggled to tame a surge in cases despite implementing multiple rounds of restrictions and a state of emergency.
The Covid-19 outbreak in Malaysia has become one of the worst globally.
On a seven-day moving average basis, Malaysia recorded 483.72 confirmed Covid infections per million people on Wednesday — the eighth highest globally and top in Asia, according to the latest data compiled by online repository Our World in Data.
Meanwhile, the country’s daily reported deaths relating to Covid were around 4.90 per million people on Tuesday on a seven-day moving average basis. That’s the 19th highest globally and third highest in Asia, the data showed.
Our World in Data is a collaboration between researchers at the University of Oxford and U.K. non-profit organization Global Change Data Lab.

PETALING JAYA: All Umno MPs must withdraw their support for Prime Minister Muhyiddin Yassin, party president Ahmad Zahid Hamidi announced today, hours after the fiasco over the emergency ordinance.
In a statement, he also called on Muhyiddin and law minister Takiyuddin Hassan to resign honourably after failing to get the King’s consent to revoke the emergency ordinances, despite announcing the revocation on Monday.
“This is clearly a form of treachery against the King while going against the Federal Constitution.
“Umno MPs must comply with the Umno supreme council’s decision on July 7 to withdraw support from Muhyiddin as prime minister.
“This is in line with the foundation and goal of Umno’s establishment, which is to always preserve and uphold the institution of Malay Rulers, as enshrined under Article 3 of the Umno constitution,” he said.

PETALING JAYA: “Heads must roll” – this was what former international trade and industry minister Rafidah Aziz said, after the disclosure by the Palace that the Yang di-Pertuan Agong had not consented to the revocation of the emergency ordinances (EOs).
“This is blatant marginalisation of the King, and certainly cannot be condoned,” said Rafidah, who just days ago called the government’s revelation of the revocation of the EOs “one of the lowest points in Malaysia’s parliamentary democracy”.
“This government has clearly ignored democratic processes as enshrined in the Federal Constitution,” she told FMT, adding that this was “yet another fiasco engulfing this backdoor government”.
Earlier, Istana Negara said Putrajaya did not obtain the King’s consent to revoke the EOs when law minister Takiyuddin Hassan announced the annulment, effective July 21, in the House on Monday.
In a Twitter post, former law minister Zaid Ibrahim called on Muhyiddin Yassin to step down.
“If the prime minister and his Cabinet do not resign today, where do we Malaysians put our faces?” he asked. “Expect a new government next week.”
Zaid said it was time for Umno to take a stand and be true to its promises to defend the honour and integrity of the Malay Rulers.

PETALING JAYA: Law minister Takiyuddin Hassan must resign after the revelation that the Yang di-Pertuan Agong had not consented to the revocation of the emergency ordinances, says an analyst.
“Heads have to roll,” said Oh Ei Sun of the Singapore Institute of International Affairs. “Misleading the house is very serious. Takiyuddin must go.”
“If Muhyiddin Yassin has any sense of dignity in him, he should also resign because Takiyuddin’s statement was made on behalf of the government.”
Oh said Takiyuddin may have just been following orders, but the fact that the words came from the minister’s mouth meant that he had to take political responsibility.
He added that the prime minister would likely attempt to hold onto power for as long as possible, but he would have to “sacrifice” either Takiyuddin or Attorney-General Idrus Harun.

PETALING JAYA: Two lawyers say Prime Minister Muhyiddin Yassin and the Cabinet must resign for misleading Parliament and acting unilaterally in revoking the emergency ordinances without the King’s consent.
Constitutional lawyer Dominic Puthucheary said it was a serious matter to mislead Parliament, adding that the government had also misled the King.
He also said this fault could not be attributed to law minister Takiyuddin Hassan alone, as the supposed revocation was done in the name of the government.
“Therefore, there’s collective responsibility. This means that the prime minister and the whole Cabinet was involved.
“The issue of the Emergency is very important. It’s one of the most unusual provisions in the constitution and has to be responsibly executed. If the government fails to do so, then they are acting in bad faith and, therefore, must resign,” he told FMT.

KUALA LUMPUR: Dewan Rakyat Speaker Azhar Azizan Harun debated with an opposition MP on whether the revocation of the emergency ordinances (EOs) needs to be debated and voted on in Parliament.
The exchange between Azhar and Gobind Singh Deo (PH-Puchong) marked the start of the fourth day of the special Dewan Rakyat sitting and saw both parties cite provisions of the law.
The issue of the revocation of the EOs has been a point of contention, and Azhar today explained why it need not be debated, referring to Article 150(3) of the Federal Constitution.
The constitution, he said, states that any emergency proclamation must be “laid” before Parliament, not “tabled”, pointing out the wording of the constitution was specific on this.
Similarly, Schedule 13 of the constitution states that the Election Commission’s report on the delimitation of constituencies must be laid before the House, he said.

PETALING JAYA: Putrajaya did not get the Yang di-Pertuan Agong’s consent to revoke the emergency ordinances when law minister Takiyuddin Hassan announced the revocation on Monday, Istana Negara said.
“The King stresses that the minister’s statement in Parliament on July 26 is inaccurate and misled the members of the Dewan Rakyat,” said Comptroller of the Royal Household Ahmad Fadil Shamsuddin in a statement today.
Fadil said Articles 150(2B) and 150(3) of the Federal Constitution clearly gave the authority for the enactment and revocation of ordinances to the King.
He said the King was aggrieved by Takiyuddin’s statement on Monday since he had yet to consent to the revocation.
What the King told Takiyuddin and Attorney-General Idrus Harun during a virtual audience, he said, was that the revocation of ordinances should be tabled and debated in Parliament.

Ipsos survey: Covid-19 pandemic has magnified divisions between elites and regular people in Malaysia, globally
KUALA LUMPUR, July 29 — Seventy-five per cent of Malaysians believe, like their counterparts in other countries, that the current system is rigged against them, a recent survey has found.
The survey by market analysts Ipsos also found that more than half of Malaysians believe that the country is in a decline and that politicians do not care about the people.
The latest finding based on the study titled “Fracturing Societies and Systems” revealed that a majority of people in the countries surveyed globally think their nation is in a decline — a sentiment also shared by more than half of Malaysians.
The study showed that 80 per cent of Malaysians polled feel that the nation needs strong leadership to take the country back from the rich and powerful.

KUALA LUMPUR, July 29 — Aaron Chia-Soh Wooi Yik pulled off a massive upset in the men's doubles badminton quarter-finals at the Tokyo 2020 Olympics today, with a scintillating straight-sets win over favourites and World No. 1 pair Marcus Fernaldi Gideon-Kevin Sanjaya from Indonesia .
The duo needed only 33 minutes to beat them and book their spot in the semi-finals tomorrow.
After winning the first set 21-14 in 13 minutes, the world No. 9 pair had a tougher time in the second set. After racing to a 16-12 lead they lost four points in a row before winning their next point to make it 17-16.
However, from then on, Chia and Soh never made a mistake and eventually won it 21-17 in 21 minutes to take the second set and book their first ever semi-finals appearance at an Olympic games.
