  Muhyiddin’s appointment proves PM not serious about recovery plan, says DAP

PETALING JAYA: DAP has accused Prime Minister Ismail Sabri Yaakob of being flippant about the national recovery plan (NRP) following the appointment of his predecessor as chairman of the council overseeing the initiative.

Party secretary-general Lim Guan Eng said the NRP was supposed to be a roadmap to control the Covid-19 pandemic while progressively reopening society and the economy towards achieving the new normal by December 2021.

Due to its importance, the council has been chaired by the prime minister, with members comprising experts as well as politicians from both sides of the political divide.


By appointing former prime minister Muhyiddin Yassin to chair the National Recovery Council instead of himself, Ismail is “diminishing its importance and relegating its powers to just another ordinary committee”.

“It shows that Ismail is not serious and committed to the NRP. Further, this appointment is seen as a form of political consolation for Muhyiddin after being forced to resign as prime minister,” Lim said in a statement.

PETALING JAYA: The appointment of a “failed” prime minister to head a vital body like the National Recovery Council shows Prime Minister Ismail Sabri Yaakob is treating the government like a “playground”, says veteran newsman A Kadir Jasin.

He said the move is obviously to secure Ismail’s position because former prime minister Muhyiddin Yassin heads the Bersatu party which has 31 MPs needed to keep him in power.

“Muhyiddin lost his support in Parliament and he has been appointed to rehabilitate the country after damaging much of it. What kind of madness is this?


“Ismail does not care because it’s not his money. It’s taxpayers’ money,” Kadir wrote on his Facebook page.

Ismail was backed by 31 Bersatu MPs to form the new government after Muhyiddin resigned last month.

I find the debate in the media on the Federal Constitution to be interesting. There is one thing the jurists and legal pundits are missing out in their arguments.

One of the tools of interpreting a contract or statute or the Federal Constitution is the application of common sense.


Without the application of common sense, a just result according to the spirit and intent of rule of law cannot be achieved.

For example, it is clear the King under Article 40 (2)(a) appoints the prime minister and the criteria in the first instance is that who he thinks has the majority support.

This Article must be read with Article 43 (4) which says the prime minister must tender his resignation if he does not have the majority support.

Motion of confidence in a newly sworn-in prime minister following a change of leadership is legit

SEPT 5 — Before the current parliamentary term which has seen two changes of leadership, there were two other changes of leadership during a parliamentary term.

Both changes were followed by a motion of confidence in the newly sworn-in prime minister in the Dewan Rakyat.

The first was a motion of confidence in Prime Minister Datuk Hussein bin Onn who was sworn in as prime minister on January 15, 1976 following the death of Tun Abdul Razak in London on January 14, 1976.

On January 27, 1976 a motion of confidence in Hussien Onn was moved by Kuala Kedah MP Datuk Senu bin Abdul Rahman as follows:

“Bahawa Dewan dengan ini mengucapkan setinggi-tinggi tahniah atas perlantikan Yang Amat Berhormat Datuk Hussein Onn sebagai Perdana Menteri dan menyatakan kepercayaan penuh terhadap pimpinan beliau dan berikrar memberikan kerjasama dan sokongan sepenuhnya kepada beliau bagi melaksanakan tugas dan tanggungjawabnya.”

After a two-hour debate, the motion was agreed and passed by the Dewan Rakyat.

The second motion of confidence was in Prime Minister Dato’ Seri Abdullah Bin Haji Ahmad Badawi who was sworn in as prime minister on October 31, 2003 after Datuk Seri Dr Mahathir Mohamad stepped down as the fourth prime minister.

Pakatan: AG should resign over ‘wrong’ advice that new PM need not prove majority in Parliament

KUALA LUMPUR, Sept 5 — Attorney General Tan Sri Idrus Harun should resign after having given alleged “wrong” advice that newly-appointed Prime Minister Datuk Seri Ismail Sabri Yaakob does not need to validate that he has majority support in the Dewan Rakyat, federal Opposition Pakatan Harapan (PH) said today.


PH’s presidential council today said it was shocked over the attorney general’s statement yesterday that a vote of confidence is not needed in the Dewan Rakyat, as it is contrary to the Yang di-Pertuan Agong’s wishes for the new prime minister to present a motion for a vote of confidence in the Dewan Rakyat as soon as possible.

“Pakatan Harapan urges the attorney general to resign as he has not only been traitorous towards the Seri Paduka Baginda, but he has also betrayed the Federal Constitution and the parliamentary democracy system,” the PH presidential council said in a statement, referring to the Yang di-Pertuan Agong as Seri Paduka Baginda.

SHAH ALAM – Raja Muda of Selangor Tengku Amir Shah Sultan Sharafuddin Idris Shah has denied any links to a developer or any development project in the Kuala Langat North Forest Reserve (KLNFR).

“Some groups believe I am benefiting from such a decision. I would like to make my position clear: I have no link to Gabungan Indah Sdn Bhd or any development project in KLNFR,” he said in an Instagram post today.

This is in reference to a decision to degazette KLNFR, with the state Forestry Department in a statement on Wednesday saying it is in line with Selangor’s development goals towards socioeconomic stability and sustainability.

It stressed that the state government is maintaining about 46% of the forest in Tg Dua Belas, Kuala Langat, as a permanent reserve.

The proposal to degazette the forest reserve had undergone a thorough public investigation since the decision on the matter was received in November 2019, it said.

“The state government has also imposed several conditions on the developer Gabungan Indah, including retaining 20% of the development area as a green area, as well as the need for the translocation of flora and fauna species of interest.”

  Philippine Airlines files for bankruptcy

MANILA – Philippine Airlines said today it was filing for bankruptcy in the United States to slash US$2 billion (RM8.3 billion) in debt as it tries to survive an industry gutted by the coronavirus pandemic.

The national carrier of the Philippines said the filing will allow it to restructure contracts and cut debt by at least US$2 billion while getting US$655 million in fresh capital when it emerges from the Chapter 11 process.

PAL will also downsize its fleet by 25% and renegotiate contracts to reduce lease payments.

“Philippine Airlines will continue business-as-usual operations while finalising the restructuring of our network, fleet, and organisation,” senior vice-president and chief financial officer Nilo Thaddeus Rodriguez said in a video message.

As part of agreements reached with suppliers, lenders, and lessors, Rodriguez said PAL will secure US$505 million to execute the recovery plan. The money will later convert into airline equity and long-term debt.

It will also obtain another US$150 million in debt funding after it emerges from the restructuring process “in a few months”, Rodriguez said.
