  Taliban orders university women in Afghanistan to wear face-covering niqab

KABUL (AFP) - Women attending private Afghan universities must wear an abaya robe and niqab covering most of the face, the Taliban has ordered, and classes must be segregated by sex - or at least divided by a curtain.

In a lengthy document issued by the Taliban's education authority, it also ordered that female students be taught only by other women, but if that was not possible, then "old men" of good character could fill in.

The decree applies to private colleges and universities, which have mushroomed since the Taliban's first rule ended in 2001.

During that period, girls and women were mostly excluded from education because of rules regarding same-sex classrooms and the insistence that they be accompanied by a male relative whenever they leave the house.



There was no order for women to wear the all-enveloping burqa in the new regulations issued late on Saturday (Sept 4), but the niqab effectively covers most of the face, leaving just the eyes exposed.

In recent years burqas and niqabs have largely vanished from the streets of Kabul, but are seen more frequently in smaller cities and towns.

AG’s position goes against spirit of Malaysia’s constitutional democracy – joint statement

WE, the undersigned civil society groups, respond to Attorney-General Tan Sri Idrus Harun’s statement on September 4. The attorney-general referred to the operation of Articles 40(2)(a) and 43(2)(a) of the federal constitution and drew two conclusions as a result:
 
1) His Majesty the Yang di-Pertuan Agong’s power to appoint a prime minister is an absolute power (kuasa mutlak); and,
2) Any step by the Dewan Rakyat to verify whether or not Prime Minister Datuk Seri Ismail Sabri has the confidence of the majority of the members of the Dewan Rakyat through a direct vote in the House would be an attempt to supplant the alleged absolute power of the Agong.
 
With respect to the office of the attorney-general, Idrus’ conclusions are preposterous. It goes against the spirit and letter of Malaysia’s constitutional democracy and embarrasses the office of the attorney-general. In light of the same, the public deserves to know Idrus’ advice to the government and the Agong on these issues.
 
First, is it Idrus’ position that Malaysia is governed by a monarchy with absolute power? As every Malaysian knows, Malaysia practises a system of parliamentary democracy with a constitutional monarchy, under which no institutions have absolute power – whether it is the constitutional monarch, the executive, Parliament or the judiciary. All of these institutions exercise their powers based on the limits imposed under the constitution, the principles of constitutional democracy and the rule of law. His Majesty the Yang di-Pertuan Agong has himself stressed this point to the government on a number of occasions in the past few months, and we refer to, for example, the statements from the Istana Negara dated July 29 and August 18. As eminent scholars have explained, a constitutional monarch’s discretion under Articles 40(2)(a) and 43(2)(a) is a “controlled discretion” because “no discretion can be absolute and must be exercised within the parameters of the law and conventions.” (Faruqi 2020, p. 6).

  End confusion over ‘No Anwar, No DAP’ stand, Azalina tells Umno

PETALING JAYA: Umno must work to address confusion among its grassroots over its cooperation with the opposition, which seems to run counter to the “no Anwar, no DAP” policy adopted at its general assembly, a Supreme Council member said.

Pengerang MP Azalina Othman Said said it was easy for MPs to deal with opposition counterparts but the rationale must now be clearly communicated to supporters on the ground.

“The confusion would be more for the divisions who are aware of the ‘No Anwar, no DAP’ stand, but now suddenly there is a flip side to it,” she told FMT.


Azalina, who recently quit as deputy speaker of the Dewan Rakyat, said the party’s decision to cooperate with the opposition did not have much of an impact for MPs because they regularly met with their opposition counterparts in Parliament.

She said it was also not uncommon in certain legislative assemblies.

PETALING JAYA: Malaysia should abandon the “drama” of preparing its five-year plan and do something real for now by focusing on a few specific areas that warrant urgent attention from a responsible government, says a former minister.

Former law minister Zaid Ibrahim said the previous five-year plans were a waste of time and money as they were never discussed at great length by the ruling party and were probably prepared by “some senior civil servants with the help of foreign consultants”.

Zaid said the public would have been impressed by the “breadth and depth” of the previous plans, but nothing substantial or significant was implemented fully and targets were not achieved after the five-year period.


“What happened to our great industrialisation plan, the plan for unity and rebirth of the nation? What happened to achieving the dreams of 2020 where the country will prosper like First World countries?” he asked in a Facebook post.

“What happened to science and innovation in our education system? Where are the plans for a high-income economy and the empowerment of the people?”

THERE have been calls for the prime minister to table a motion of confidence when Parliament reconvenes in order for the premier to demonstrate to the members of the House of Representatives, and by extension, to the rakyat that he has the support of the majority of MPs as required under the federal constitution.

Fundamentally, a motion of confidence, which is the reverse to a motion of no confidence, is to evince to Parliament that the prime minister commands the majority of the members of the Dewan Rakyat.

However, there is no requirement in the federal constitution that the prime minister, after having been elected by the Yang Di-Pertuan Agong upon the resignation of Tan Sri Mahiaddin and before a general election is called, must table a motion of confidence to prove that he commands the majority of the house

When the previous prime minister had resigned, and the seat of the prime minister became vacant, the power to appoint Datuk Seri Ismail Sabri Yaakob as the new prime minister was solely at the king’s discretion in accordance with Article 43(2) of the federal constitution.

In this regard, in conformity with the federal constitution, all that is required of the king, in exercising his discretion, is solely for His Majesty and no other person to be satisfied that the newly elected prime minister, in His Majesty’s opinion, commands the confidence of the majority of MPs.

  Cabinet does not inspire confidence

When you see the dreary Cabinet line-up with the usual faces of politicians who have been around for decades, do you feel inspired? No!

What else do you see? Many yes-men!

Despite Ismail Sabri Yaakob’s reassurances, few people, including many Malays, have confidence in the new government.


The Muhyiddin Yassin administration failed to kickstart the economy and save businesses and jobs. Despite emergency rule, the previous prime minister failed to contain the Covid-19 pandemic.

Muhyiddin allowed his ministers and supporters to flout the social distancing and lockdown rules, then expected the rakyat to rigidly obey them. Why should they? Will Ismail allow the same double standards to continue?

The nation faces an uncertain future and the rakyat are afraid. Swapping ministers around like passing the parcel is not going to give them confidence in the Cabinet. Most of the ministers are known for their lack of performance in previous Cabinets. They have no new ideas about solving Malaysia’s innumerable problems, many of which revolve around race, religion and rasuah. How successful will this new Cabinet be in jumpstarting the economy?

THE attorney-general (AG) is wrong to have disregarded the confidence convention in saying a vote of confidence will undermine the Yang di-Pertuan Agong’s appointment of Datuk Seri Ismail Sabri Yaakob as prime minister.

A written constitution, no matter how detailed, is supplemented by constitutional conventions. The Malaysian federal constitution being modelled on the United Kingdom’s unwritten constitution is inlaid with constitutional conventions. The constitutional conventions are the unwritten rules that make the written rules work. The AG’s interpretation of the constitution without considering the constitutional conventions is erroneous.

The meaning of ‘responsible government’

The AG has failed to give effect to the concept of a “responsible government” in his statement. The term has a very precise constitutional meaning.

It means that a government – consisting of the prime minister and his cabinet – must at all times enjoy the confidence of the majority of the MPs. This rule is the foundation of the parliamentary democratic system. The name given to this rule is the “confidence convention”.

Under this rule, the government is responsible to Parliament for the exercise of the powers of government and governs only as long as it has the confidence of the majority-elected MPs – hence the term “responsible government.”

Articles 43(2), (3) and (4) operate on the basis of the confidence convention:

- Article 43(2)(a) provides that the Agong is to appoint a prime minister who in his judgment is likely to command the confidence of the majority MPs.
- Article 43(3) provides that the cabinet is collectively responsible to Parliament.
- Article 43(4) provides that if the prime minister ceases to command the confidence of the majority unless the Agong at the prime minister’s request dissolves Parliament, he is required to resign.

IT was only supposed to fly five times. And yet Nasa's helicopter on Mars, Ingenuity, has completed 12 flights and it isn't ready to retire.

Given its stunning and unexpected success, the US space agency has extended Ingenuity's mission indefinitely.

The tiny helicopter has become the regular travel companion of the rover Perseverance, whose core mission is to seek signs of ancient life on Mars.

"Everything is working so well," said Josh Ravich, the head of Ingenuity's mechanical engineering team. "We're doing better on the surface than we had expected."

Hundreds of people contributed to the project, though only about a dozen currently retain day-to-day roles.

Ravich joined the team five years ago.

  Reopen economy instead, think tank says on raising debt limit

PETALING JAYA: A think tank has called on the government to implement several measures, including expediting the reopening of the economy, following a proposal to raise the current debt limit.

The Center for Market Education (CME) said increasing the debt limit risks several “negative unintended consequences“ generated by additional borrowing.

This includes additional debt transferred to future generations, not only in terms of money but also a weaker currency and fewer job opportunities, its chief executive officer Carmelo Ferlito said.


It would also further worsen Malaysia’s credibility and investors’ confidence as well as limit private investments.

Additional demand for loanable funds, he warned, could push up the interest rate and discourage private investments and limit growth and job creation.

PETALING JAYA: Umno veteran Shahrir Samad has slammed Attorney-General Idrus Harun’s contention that the prime minister should not have to go through a confidence motion in the Dewan Rakyat.

In an Istana Negara statement on Aug 18, the Yang di-Pertuan Agong had decreed that the prime minister he appointed had to table a motion of confidence in the Dewan Rakyat.

Ismail Sabri Yaakob was named the country’s ninth prime minister two days later.


However, Idrus yesterday said there was no need for Ismail to table a confidence vote in the Dewan Rakyat as it would mean the absolute power of the King could be overridden, adding that this was also not in line with the Federal Constitution.

“There will continue to be chaos in our country’s systems of parliamentary democracy and constitutional monarchy as long as Idrus remains the attorney-general,” Shahrir said in a statement.
