  SRC judgment: So, what happened to the RM4 billion?

The Court of Appeal has ruled that the High Court which found Najib Razak guilty on seven charges of criminal breach of trust (CBT), money laundering and abuse of power was right in doing so.

The former prime minister will certainly appeal to the Federal Court to overturn this decision, just as certainly as he will burnish his public image in his continuing appeal to the court of public opinion.

But, for now, four judges are in total agreement about Najib’s guilt in the sordid affairs of SRC International Sdn Bhd – a former 1Malaysia Development Bhd (1MDB) subsidiary.

I found the observations made by the Court of Appeal very interesting and I’d like to share some of these, and my own thoughts, here.

  US intensifies crackdown on Chinese tech companies

The US government's attempts to crack down on China's high-tech sector have shown a tendency to intensify in scope and frequency in recent days, with the Biden administration on Thursday moving to ban a string of Chinese tech companies from receiving US capital and supplies, just days after Chinese artificial intelligence (AI) giant SenseTime was put on a US investment blacklist.

However, such a move will bring more harm to US firms than to the Chinese economy, as US investors will be forced to give up many chances to reap profits in China's rapidly developing high-tech sectors, experts said. 

The US Commerce Department announced on Thursday it will place export restrictions on several Chinese companies that use biotechnology and other technologies for national security reasons, including what it claimed were their roles helping the Chinese military and alleged human rights abuses against "ethnic and religious minority groups."

KUALA LUMPUR, Dec 17 — Parti Warisan has arrived in Peninsular Malaysia with the launch of the party’s national chapter today.

President Datuk Seri Shafie Apdal said he was aiming to put Malaysia’s strongest asset, its people, back in the forefront without biases or a focus on race and religion.

Shafie said many have used Malaysia’s diversity to divide the nation.

“We cannot allow the voices of these bigots to take over the voices of reason in this country. We surely cannot allow these extremists to roam our airwaves and continue to poison the minds of our people.

  PKR set to re-strategise, cement leadership ahead of GE15

KUALA LUMPUR – Having endured a rough past couple of years, PKR may now be looking at re-strategising the party ahead of the all-important 15th general election due in less than two years. 

While the nature of the move is yet unknown, discussions are expected to get underway as early as the beginning of next year.

According to PKR communications director Fahmi Fadzil, the matter ought to be deliberated no later than soon after the Sarawak election, which will be held tomorrow.

“We must remember PKR has not had the opportunity to restructure the leadership after the Sheraton Move in March 2020,” he told The Vibes yesterday.

“I think after the Melaka and Sarawak elections conclude, the leadership will need to seriously consider how we must re-strategise because this is about the future of the party.”

Fahmi stopped short of elaborating on the strategy, but ruled out the possibility and need for change among the top echelons of the leadership.

“Not at this point,” he said, when asked by The Vibes about the matter.

THE proposed amendments to the Prevention and Control of Infectious Diseases Act 1988 (Act 342) will have dire consequences on our way of life.

The proposals are dangerous and can lead to a totalitarian system reminiscent of autocratic regimes, where the people are at the mercy of officials whose subjective suspicions and discretionary powers will result in disproportionate and chaotic enforcement of the law and a breach of our fundamental rights.

It’s worse that agencies such as local councils being given sweeping powers is cause for worry.

Discretion leads to abuse of power and corruption.

This may come across as a dramatic and extreme analogy but in essence this is what the government is going to achieve in the name of curbing a virus about which, two years on, we are still finding out more about.

PETALING JAYA: Malay society has increasingly lost its sense of shame and this is the main reason for the systemic corruption in the country, said former education minister Maszlee Malik.

Noting the Japanese practice of “sepukku” or “hara kiri”, the ritual suicide practised as an alternative to disgrace, Maszlee pointed out that the feeling of shame was important for them, adding that the Chinese also had the concept of “preserving face”.

“In the Malay community, too, we used to have this feeling of shame. Now, we have increasingly lost that,” he told a forum titled Corruption and Hypocrisy in Malay-Muslim Politics yesterday.

“Now, we see people who are not embarrassed to take money, steal or receive bribes and even if they are too lazy to work.

KUALA LUMPUR – Outspoken lawyer and activist Siti Kasim will be making her political debut in the widely talked about 15th general election (GE15) as an independent candidate under the Gerak Independent (GI) movement. 

In a press conference in conjunction with the launch of the movement’s app and candidate announcement today, the social activist said she is eyeing an urban parliamentary seat but did not divulge further details.

Siti added that GI candidates are ready to take on “bullfrogs” such as former prime ministers Tan Sri Muhyiddin Yassin and Datuk Seri Najib Razak in their respective seats.

“We aim to win. We are not here to play the fool, we take this seriously.

“We are not trying to bring down or demonise anyone but we must start something different – an approach which has not been done before in Malaysia but has been done in Western countries.

“We want to show that you can have good people in the Parliament, not just based on political parties, and you can form a government even though there are more independent MPs than political parties,” she said.

MIRI – The authorities have been urged to investigate the contents of a video which is making its rounds online purportedly showing money being offered to attendees at a Gabungan Parti Sarawak (GPS) longhouse event.

Sarawak PKR information chief Abun Sui said the video clearly showed a person standing beneath a GPS banner.

“The video shows the man below a big GPS banner, talking on a stage located in a longhouse.

“He is clearly heard as saying to his audience that money will be given to voters and it is to be collected from a certain person after polling.

“The Election Commission and MACC (Malaysian Anti-Corruption Commission) must probe and take action swiftly.

“This blatant use of money to entice voters must be stopped now.

PETALING JAYA: Two economists have backed Putrajaya’s decision to refrain from regulating cryptocurrencies, with one saying it would be an onerous undertaking and the other welcoming the challenge to a government monopoly.

Geoffrey Williams of the Malaysia University of Science and Technology said regulators would find themselves constantly chasing errant traders since cryptocurrencies were private assets generated in unregulated global markets.

PETALING JAYA: Imposing harsher punishment and fines on those flouting Covid-19 SOPs will not be effective in ensuring public compliance, according to infectious disease expert Dr Adeeba Kamarulzaman.

She said criminalisation of behaviour to deter infectious diseases has proven to be ineffective.

“People will find ways to overcome this,” she said during a webinar organised by Khazanah Research Institute today,

It would also lead to inequality, she added. The wealthy will be able to get away with a RM10,000 fine while the poor may end up in prison for failure to pay the fine.


Adeeba said she was in favour of more enforcement of existing laws for those flouting SOPs.
