Confidence motion on PM will not erode King’s authority |

From Philip Koh
The honorable attorney-general (AG) of Malaysia holds a constitutional office pursuant to Article 145 of the Federal Constitution. His views on the law ought to be given respect and due attention. The AG is the first legal officer of the nation as he takes precedence over any other persons appearing before any court or tribunal in the federation.
In the press release issued by the AG dated Sept 4, he gave his learned opinion on the powers and authority of the Yang di-Pertuan Agong to appoint the person to be PM who in his judgment is likely to command the confidence of the majority, “in accordance with Article 43 of the Constitution”.
This aspect of his opinion is flawless and clearly apt and as provided for under Article 42 (2)(a). The King “may act in his discretion in the performance of the following functions, that is to say: (a) the appointment of a prime minister.”

YOURSAY | What does the future hold for Anwar? |

Multi Racial: Firstly, Anwar failed was because there was no united opposition front. All should not just join hands to support Anwar, but also help to convince MPs who share the same principles to join Harapan.
Instead, the opposition is split between Anwar and Shafie. I believe Shafie could be a potential PM one day but he needs to be reasonable and patient. How could he expect to be PM when he only has eight MPs in his party? He would be a weak PM.
There is also obviously no intention on his part to support Anwar and that mainly came from Dr Mahathir Mohamad. For whatever reason, Shafie is indebted to Mahathir. If he wants to be our nation’s leader, he has to first learn to be his own man and not someone’s lackey.
No doubt, Anwar is not perfect and he has his fair share of mistakes. Among those were when he was in power in Umno. He, together with Mahathir, were primarily responsible for the Islamisation of our country. But he has since changed. He has done a lot in reforming our nation.
Twenty years ago, we would be laughed at if we said the opposition could win the general election. But in GE14, they did it. Many gave credit to Mahathir, which personally, I think is wrong. The person we have to credit is Anwar.
Don’t forget that Mahathir’s party, Bersatu, lost the most seats they contested, and some of them even lost their deposits. Remember, his party was contesting against Umno and PAS.
Malaysians should not be ungrateful. Anwar never gave up on us and we should not either.
In my opinion, Anwar is still capable and should continue to lead us to GE15. I hope many good leaders from all races would join the fight. This includes Shafie.

Despite Agong’s call, AG says no need to prove Ismail Sabri’s command of majority in Parliament
KUALA LUMPUR, Sept 4 — Attorney-General Tan Sri Idrus Harun today said there is no need to validate the appointment of Datuk Seri Ismail Sabri Yaakob as prime minister, despite a previous call by the Yang di-Pertuan Agong for a vote of confidence in Parliament.
Idrus said the appointment of Ismail Sabri on August 21 was valid and in line with Articles 40(2)(a) and 43(2)(a) of the Federal Constitution, as the Agong had already received statutory declarations from the 114 MPs backing the prime minister, and later held an audience with them.
“If the appointment of a new prime minister is still needed to be validated by any party other than His Majesty, this means that His Majesty’s absolute power can be overcome by other parties.

China role in Afghanistan to face organised crime cartels, rampant corruption |

- With the departure of the US and its allies there is speculation China can step in to help rebuild the war-torn country
- But Chinese investors are likely to run into the same corruption problems as their American predecessors
China’s meetings in July with Taliban leaders who now look set to rule in Afghanistan generated speculation that Chinese investment and influence would flow into the country after the departure of the US and its allies.
However, if China – as Afghanistan’s wealthiest and most powerful neighbour – sees opportunity as the US exits, reports by the US Special Inspector General for Afghanistan Reconstruction (SIGAR) make for sobering reading.
SIGAR warned for years that corruption and crime networks were poisoning efforts to establish an Afghan national government, not least because the heads of the crime cartels were often part of the government, siphoning off billions of dollars in aid and undermining public support in the process.

Enough is enough, get rid of Sedition Act, groups cry as more activists hauled up |

KUALA LUMPUR – Civil society organisations are demanding the government stop using the archaic Sedition Act 1948 to impede freedom of expression, after seven activists were hauled up by police today for questioning under the legislation.
In urging the authorities to drop all investigations against #Lawan organisers and other human rights defenders, the groups demanded the urgent reinstatement of the moratorium on the Sedition Act, as well as its immediate repeal.
The CSO Platform for Reform steering committee urged the government to act now and not be complicit in allowing the human rights in Malaysia to deteriorate further.
In a statement, it said the use of the Sedition Act has created a chilling climate of fear, hindering citizens from exercising their constitutionally guaranteed freedom of speech and expression, signalling a downward spiral into an authoritarian state.
For these reasons, it said the Act is long overdue for repeal.

PETALING JAYA: Time is running out for about 580,000 small and medium enterprises (SMEs) because if the economy is not fully opened by next month, many of them will collapse, says DAP secretary-general Lim Guan Eng.
The former finance minister said, however, that the full opening does not look possible with the current high number of daily Covid-19 cases and deaths.
Lim said his assessment was based on a statement by former entrepreneur development and cooperatives minister Wan Junaidi Tuanku Jaafar in which he said that SMEs had suffered RM40.7 billion losses last year, with 580,000 businesses, representing 49% of the SME sector, facing the risk of collapse.
“With the number of daily deaths and infections continuing to remain high, there are doubts the economy can be fully reopened by October,” Lim said in a statement.
Yesterday, Malaysia reported 330 deaths and 19,378 new infections.

THE HAGUE, Sept 3 (Reuters) - Afghanistan's 250 women judges fear for their lives, with men they once jailed now freed by the victorious Taliban to hunt them down.
While some women judges were able to flee in recent weeks, most were left behind and are still trying to get out, said judges and activists working around the clock to help them escape.
The militants, who swept into power last month as the United States withdrew its troops, banned women from most work when they last ruled the country 20 years ago. They have said women's rights will be protected, but have yet to provide details.
Women who work in justice have already been high profile targets. Two female Supreme Court justices were gunned down in January. read more
Now, the Taliban have released prisoners across the country, which "really put the lives of women judges in danger," a high-level Afghan women judge who fled to Europe said from an undisclosed location.
In Kabul, "four or five Taliban members came and asked people in my house: 'Where is this woman judge?' These were people who I had put in jail," she told Reuters in an interview, asking not to be identified.
