Opposing views within PAS wings on MACC, Azam Baki debacle |

KUALA LUMPUR – Separate wings of Islamist party PAS have issued opposing views about the recent debacle involving the Malaysian Anti-Corruption Commission (MACC) and its chief commissioner Tan Sri Azam Baki.
A statement issued by PAS secretary-general Datuk Seri Takiyuddin Hassan yesterday commended Azam for clearing the air about the alleged conflicts of interest brought against him, saying it was the right thing to do to maintain the perception and integrity of MACC.
“PAS applauds steps taken by MACC’s chief commissioner Tan Sri Azam Baki, who openly addressed the accusations by several media agencies and independent portals against him concerning alleged ownership of shares in several companies.
“The open statement by MACC’s chief commissioner that denied these accusations can hopefully put an end to the actions of certain parties who appear to be raising the issue deliberately, as though they intend to trigger doubt among the people and cause instability in the country under the leadership of Prime Minister Datuk Seri Ismail Sabri Yaakob.”
Takiyuddin said that the burden of proof now lies with Azam’s accusers to present their evidence against the chief commissioner, adding that he hopes to see authorities taking fair and impartial action against all involved in the episode, if needed, and for it to be based on the rule of law.

KUALA LUMPUR – Legal experts have questioned the veracity of Malaysian Anti-Corruption Commission (MACC) chief commissioner Tan Sri Azam Baki’s claim when he told the press that he had done nothing wrong when he allowed his brother to purchase shares using his trading account.
Speaking to The Vibes, the senior counsels even expressed doubts towards the legitimacy of statements made during the entire press conference held on Wednesday at the MACC headquarters that prominently featured Azam and the Anti-Corruption Advisory Board (LPPR) chairman Tan Sri Abu Zahar Ujang.
Lawyer Rafique Rashid Ali told The Vibes that he found it baffling that the LPPR, which functions solely as an advisory body to the MACC, had absolved Azam from any wrongdoing.
“Azam’s own press conference must now be subject of investigation by the Securities Commission (SC). The SC must open investigations.
“The timing of the advisory council and Azam’s press conference raises more questions and concerns regarding MACC’s integrity, more so when rumours have been swirling around for quite a bit.
“In short, Azam’s explanation is untenable,” Rafique said when contacted.
Senior criminal lawyer Fahri Azzat also weighed in, pointing out how Azam’s explanation given during Wednesday’s press conference that the purchased shares were meant for his brother was far from concrete.
“I think his excuse that it is his brother’s (shares) is predictably lame,” he told The Vibes

KUALA LUMPUR – Despite DAP’s long-standing struggle in gaining support from the Malay electorate, the party’s young leaders from the majority ethnic group say that it has provided them with opportunities to rise up the ranks.
While one DAP leader recently called for a revamp of the party’s Chinese image, Syahredzan Johan, the political secretary to party’s veteran Lim Kit Siang, believes that there is no need for a major shift in its direction.
“To me, the party is on the right track to becoming a party that is accepted by all Malaysians, including the Malays,” the 38-year-old lawyer told The Vibes when contacted recently.
“This is especially so among the younger generation. More young Malays have signed up for the party, as they see DAP as being a party that values young leaders, which is apparent in the number of young elected representatives within our ranks.”

PETALING JAYA: Umno Supreme Council member Puad Zarkashi has urged Prime Minister Ismail Sabri Yaakob to form a special task force to investigate allegations against Malaysian Anti-Corruption Commission (MACC) chief commissioner Azam Baki on his corporate share ownership.
He said the task force should be independent, transparent, and have proper terms of reference to investigate the matter comprehensively.
The recommendation came after the anti-graft agency’s Anti-Corruption Advisory Board (ACAB) chairman Abu Zahar Ujang said he would submit a report on the board’s probe on Azam to the prime minister for further action.
Puad told FMT that it was necessary for Ismail to take the initiative because people did not have confidence in the ACAB investigation.
“The people will not believe the report that will be sent by Abu Zahar to the prime minister because the board only listened to Azam’s explanations.
“Also, did they call upon other parties like Edmund Terence Gomez, the Securities Commission Malaysia, and Azam’s brother (Nasir) to make the investigation a comprehensive one?

The share trading controversy involving Malaysian Anti-Corruption Commission (MACC) chief commissioner Azam Baki is not just about him or the trustworthiness of the MACC. It is about the integrity of our institutions.
An individual can come and go but the institution remains. The degree of trust that an institution commands depends largely on the integrity of its head and officers, and its ability to act independently, fairly and swiftly.
The question, therefore, is how the MACC measures up. Not well, it appears.
There are calls for Azam to go on leave or resign in the wake of the controversy over shares that were traded with his account in 2015.
Coming out in the open on Jan 5, weeks after the allegations swirled on social media, Azam denied committing any wrong or that there was a conflict of interest on his part.
“I explained to the board (the MACC’s anti-corruption advisory board) that my trading account was used by my brother for his shares trading and I have no interest nor have any part in this. The shares were bought in the open market and my brother had financed the purchases on his own.”
It doesn’t look good on Azam because he defended himself in public only after academician Edmund Terence Gomez resigned as a member of the MACC’s consultation and corruption prevention panel on Dec 27 – after claiming that the panel had failed to discuss the allegations against Azam – and the subsequent public pressure.

PETALING JAYA: The Malaysian Anti-Corruption Commission’s (MACC) Anti-Corruption Advisory Board (ACAB) has no power to investigate or clear the agency’s chief commissioner Azam Baki of any wrongdoing, say opposition MPs.
Azam, who is alleged to own shares in public-listed companies, was yesterday cleared of any wrongdoing after the board’s chairman, Abu Zahar Ujang, said Azam had explained that his trading account was used by his brother, Nasir Baki, to purchase shares.
At a joint press conference with six other opposition MPs, Ledang MP Syed Ibrahim Syed Noh said that the ACAB’s terms of reference do not give it the mandate to investigate or clear anyone in the MACC of wrongdoing.
“How does an advisory board have the power to investigate someone and then clear them of allegations of wrongdoing?

KOTA KINABALU – There is no way a civil servant like Malaysian Anti-Corruption Commission (MACC) chief commissioner Tan Sri Azam Baki would be able to afford to buy million-ringgit shares, said two DAP lawmakers today.
Citing that all public servants are required to declare their assets, Kota Kinabalu MP Chan Foong Hin and Kota Melaka MP Khoo Poay Tiong also pointed out that the anti-graft chief’s claim that he does not need to explain to any parties pertaining the purchase of shares worth millions was also incorrect.
“Even if he does (have the funds to buy the shares), he should explain the source of the money used to acquire them.
“His salary certainly does not commensurate with the value of shares he acquired when he was the MACC head of investigation back in 2015,” they said in a joint statement today.
Both federal lawmakers, who are also members of the Parliamentary Select Committee, said the claim that the shares were bought by Azam Baki’s brother, Nasir Baki, was also unacceptable.
Azam had claimed that his brother Nasir had used his account to purchase those shares.

KUALA LUMPUR, Jan 6 — An Opposition MP today called on the Securities Commission (SC) to conduct a full probe on Malaysia Anti-Corruption Commission (MACC) chief Tan Sri Azam Baki for a possible violation of stock trading laws.
This after Azam ended his silence after being embroiled in controversy over his acquisition of millions of shares in two public-listed companies in 2015. In a news conference yesterday, he said he had allowed his brother to use his share trading account to buy those shares.
Kepong MP Lim Lip Eng said Azam’s disclosure only raises further questions and cited Section 25 (6) of Securities Industry (Central Depositories) Act, known as SICDA for short.
“The SC has the duty to state if Azam Baki has breached any securities law,” Lim said in a statement.

KOTA BARU – The Kelantan government will not stop logging activities in the state as they are carried out in accordance with the terms and conditions stipulated under the National Forestry Act 1984, said Deputy Menteri Besar Datuk Mohd Amar Nik Abdullah.
He said logging activities in Kelantan were conducted according to stipulated regulations.
Each state is given a quota by the National Forestry Council, and the condition that after trees are felled, reforestation must be carried out in the affected area, he added.
He said the trees had a set age after which they had to be felled to avoid them falling onto and destroying other growth.
“For example, if the quota given for this year is 3,000ha, we should not exceed 3,000ha. Otherwise, we will be subject to action by the National Forestry Council. The quota is not determined by the state, but the National Forestry Council.
