PETALING JAYA: Court of Appeal judge Nazlan Mohd Ghazali has lodged a police report over a news article alleging that he is being investigated for unexplained monies in his bank account.
The office of the chief registrar of the Federal Court said Nazlan denied the “false, baseless and malicious allegations” aimed at undermining his credibility as a Court of Appeal judge.

Guan Eng calls out MACC for speedy action against Nazlan, but not Azam
PETALING JAYA: DAP chairman Lim Guan Eng has slammed the Malaysian Anti-Corruption Commission (MACC) for not “jumping” to investigate its chief commissioner Azam Baki over alleged ownership of shares and warrants worth millions of ringgit, just like it did with a report involving Court of Appeal judge Nazlan Mohd Ghazali.
“Following the confirmation yesterday that the MACC has opened an investigation paper into Nazlan following a report, we want to know why the MACC failed to act similarly against Azam for allegedly breaching the law in purchasing millions of shares worth millions of ringgit last year,” he said in a press statement today.

Anwar fears MACC probe on judge will be seen as political pressure
PETALING JAYA: Opposition leader Anwar Ibrahim has expressed his concerns that the Malaysian Anti-Corruption Commission’s probe of Court of Appeal judge Nazlan Mohd Ghazali might be seen as a form of political pressure and interference.
His comments came in response to reports that the anti-graft agency is probing Nazlan on the alleged ownership of an unexplained amount of money worth RM1 million in his bank account.
He said the judiciary was perceived to be getting back its independence and integrity after a long time, with the government not making any attempts to fix the problems all this while.

Probe into judge Nazlan raises concerns and questions among fraternity
KOTA KINABALU – The graft probe into a Court of Appeal judge is nothing short of an attack on the independence of the judiciary and the rule of law, said lawyer-activist Datuk Ambiga Sreenevasan.
She told The Vibes that the investigation into Datuk Mohd Nazlan Mohd Ghazali by the Malaysian Anti-Corruption Commission (MACC) clearly relates to the judgment in former prime minister Datuk Seri Najib Razak’s SRC trial in 2020.
She said while it is permissible to responsibly criticise a judgement, it is not permissible to launch a baseless attack on the judge.
“It is nothing short of an attack on the independence of the judiciary and the rule of law.
“These unwarranted attacks by those with little or no credibility reek of desperation and utter bad faith. In my view they are illegal.
“It is those who have launched scurrilous attacks on a highly respected judge known for his integrity and scholarship (words they are unfamiliar with) who should be investigated,” said Ambiga in defence of Nazlan.

Why no effort to get fugitive blogger back for questioning? Guan Eng asks after RPK’s claims against SRC judge
KUALA LUMPUR, April 24 — DAP chairman Lim Guan Eng today questioned the authorities over what he perceived as a lack of effort to bring fugitive Malaysian blogger Raja Petra Kamarudin back for investigation over his many questionable allegations published online.
Instead, the Bagan MP noted the Malaysian Anti-Corruption Commission’s (MACC) swift investigation into the blogger’s recent allegation on the purportedly “unexplained wealth” of a judge who had tried and found former prime minister Datuk Seri Najib Razak guilty of multiple counts of misusing RM42 million belonging to government-owned SRC International Sdn Bhd.

World is watching MACC’s Nazlan probe, warns Muda
PETALING JAYA: Malaysia’s economy and democracy would be ruined if there is foul play involved leading to Court of Appeal judge Nazlan Mohd Ghazali being investigated by the Malaysian Anti-Corruption Commission (MACC), says Muda.
“The world is watching, and if there is indeed foul play, it would be gravely damaging, economically and democratically,” said Muda vice-president Lim Wei Jiet in a statement.

An attempt to scandalise the judge?
Anon25: Fugitive blogger Raja Petra Kamaruddin (RPK) who made that scandalous allegation against Court of Appeal judge Mohd Nazlan Mohd Ghazali is known as a hired scoundrel.
But is it not scandalous also for MACC chief commissioner Azam Baki to announce that he is investigating the judge? Because as PKR president Anwar Ibrahim has pointed out, he is violating the principle of separation of powers in so doing.
Azam is obviously trying to scandalise the good judge. Without this move, the allegations from abroad would not have mattered.
Constitutional Supremacy: Anwar is right. The separation of powers must be respected. The judiciary has its check and balance over allegations made. It can hold its own enquiry if there is any foundation to the allegations.
Raja Petra is a mercenary and discredited blogger. Sarawak Report has exposed his dealings where he knowingly makes false allegations against political rivals of those whom he receives funds from.
Thus, MACC should not have opened a file as this matter should be dealt with internally by the judiciary itself.
MACC’s actions are lending credence to possible false allegations. Moreover, the evidence against Najib is so overwhelming that no judge could have acquitted him.

Justice for judges, too

As a society, we have every right to demand for honesty in a judge. It is exacting and absolute.
The standards of judicial behaviour, both on and off the Bench, are extremely high. For a judge to deviate from such standards of honesty – and impartiality – is to betray the trust reposed on him.
No excuse can condone such betrayal. A dishonest judge not only dishonours himself and disgraces his office, but jeopardises the integrity of the entire judicial system.
No one is above the law – judges included. It cannot be said that a judge will escape criminal liability because of his high office. In a civilised society, the law cannot be assumed to be leading to such disturbing results.
A judge of a superior court will not be immune from prosecution for criminal offences committed during the tenure of his office.
We can, therefore, agree with Zaid Ibrahim that judges are not immune from criminal prosecutions. The principle of “separation of powers” does not forbid the authorities from launching a probe against sitting judges.

Anon25: The MACC investigation was based on a dodgy news report by an infamous blogger based on extracts of confidential bank documents dated many years ago, which was totally unrelated to the judge's work.
Yet this was used by an NGO to demand an investigation into the judge, who had found former prime minister Najib Abdul Razak guilty of corruption.
And with that, MACC sprang into action and issued a statement that the judge was being investigated. Former prime minister Najib’s lawyer Muhammad Shafee Abdullah is also demanding a mistrial.
All this seems to have happened because of the smell of corruption surrounding MACC chief Azam Baki.

Ex-Bar presidents call for ‘walk for justice’ in defence of judiciary
PETALING JAYA: Six former Malaysian Bar presidents are calling on the current office bearers to hold a “walk for justice” in a bid to voice out against “intimidation” towards the judiciary.
In a petition, the former presidents – Mah Weng Kwai, Kuthubul Zaman Bukhari, Yeo Yang Poh, Ambiga Sreenevasan, Lim Chee Wee and Steven Thiru said “it is time for the Bar to once again rise and fearlessly defend the institution of the judiciary”.
“We, the undersigned members of the Bar, urge the Bar Council to organise a walk urgently to send a clear message to those that seek to interfere with the judiciary that this intimidation cannot be countenanced as it is a blatant violation of the rule of law,” they said.
