Simplified: How the tale of Saudi donation to Najib tanked ex-AG Apandi’s defamation suit against Kit Siang over 1MDB remarks

KUALA LUMPUR, July 23 — Former attorney general Tan Sri Mohamed Apandi Ali had in July 2019 sued DAP MP Lim Kit Siang for defamation for having publicly urged him to “explain why he aided and abetted in the 1MDB scandal”.

But the High Court on May 23 this year dismissed Apandi’s defamation lawsuit, after having found that the evidence produced in court — including Apandi’s own testimony — showed Lim as having successfully proven his defences.

On July 21, High Court judge Datuk Azimah Omar’s 100-page written judgment was made available publicly, where the judge gave a hard-hitting and took a no-nonsense approach in scrutinising all the evidence available, especially on why Apandi had not asked for continued investigations on 1MDB or SRC.

The judge stressed that Apandi’s defamation lawsuit is mainly related to the “globally infamous” 1Malaysia Development Berhad (1MDB) scandal (which also includes the SRC International Sdn Bhd case), which she said is still plaguing Malaysia to this very day and also noted that history can only regard the scandal as the “greatest and vile corruption and thievery of the modern times”.

What is Najib's response to ruling of absence of evidence of RM2.6b donation from Saudi royalty, asks Kit Siang
[Image: lim_kit_siang_by_shahrin_yahya_202107081...8yZDz4neTf]

KUALA LUMPUR (July 24): DAP veteran Lim Kit Siang has questioned as to what Datuk Seri Najib Razak's response was to the ruling by Justice Datuk Azimah Omar that there was no evidence of the RM2.6 billion fund being donated by Saudi royalty.

In a statement on Sunday (July 24), the member of parliament for Iskandar Puteri referred to the judgement in the defamation case filed by former attorney general Tan Sri Mohamed Apandi Ali against him.

It was reported that Justice Azimah, who had dismissed the suit, described in her 100-page judgement released on Thursday (July 21) that it was the most telling and revealing evidence that Apandi overtly showed disinterest and indifference to elementary rule of law and even common sense.

The court noticed this when Apandi was questioned continuously by Lim's lawyers over absolving Najib by accepting the argument that the amount of more than RM2.6 billion the former prime minister received was from Saudi royalty.

KLANG: DAP’s Charles Santiago has called on the police to investigate Apandi Ali for allegedly abusing his power as the former attorney-general to cover up the authorities’ probe into 1MDB.

The Klang MP said this was evident from the High Court’s dismissal of a defamation suit filed by Apandi against DAP veteran Lim Kit Siang.

‘Apandi’s lies show why AG’s role must be separate from public prosecutor’
[Image: 20220729-kul-charles_santiago-amar_shah_mohsen.jpg]

KLANG – The recent court judgement that found former attorney-general Tan Sri Mohamed Apandi Ali had deceived on issues relating to 1Malaysia Development Bhd (1MDB) highlights the importance of separating the role of the AG and public prosecutor.

Klang MP Charles Santiago said following this recent development, it is incumbent on Prime Minister Datuk Seri Ismail Sabri Yaakob to make the separation of powers his highest priority now.

“One of the reasons this (abuse by Apandi) happened is because of the very powerful nature of the AG, where he is both the investigator and the prosecutor,” he told reporters today.

“There also appears to be collusion between him and the former prime minister (Datuk Seri Najib Razak). This must stop. Therefore, the government must separate the AG and the public prosecutor.
